About GOGO
Trade Navigator Group SA, a company incorporated under the laws of Switzerland and having its registered office in Geneva, Switzerland, develops, operates and commercialises GOGO Booking Services within its venture lab. In connection with these activities, Trade Navigator Group SA acts as the operator of the Platform’s technical services (the “Operator”, “we”, “us” or “our”).
GOGO Booking Services is a digital platform for searching for and booking Services, facilitating interaction between Customers and Providers, providing technical tools, connecting an independent payment mechanism and making other related functions available (“GOGO” or the “Platform”).
These General Terms of Use (the “Terms”) govern the use of the Platform by individuals who search for and book Services for themselves or their Related Persons (“you”, “your”, the “Customer” or the “User”). Use of the Platform by Providers and professional users is governed by separate terms applicable to Providers.
In the relationship with the Customer concerning the creation and use of an account, the provision of Technical Platform Services, the use of paid functions and the payment of service fees, the contracting party is Trade Navigator Group SA. GOGO Booking Services and GOGO are names of the project and the Platform and are not separate legal entities.
Important Information
The Operator provides technical infrastructure through GOGO that facilitates searches for Providers, Service Bookings, communications, scheduling, connection to an independent payment mechanism and other related activities. The Operator is not a Provider, employer, representative or partner of a Provider and does not itself perform the booked Service.
The Service is provided directly by the selected Provider under the Provider’s own responsibility and without the Operator directing or controlling the manner in which the Service is performed. The Provider independently determines their prices, availability, working hours and method of performing the Service and is responsible for the legality, quality, safety, timing and result of the Service, as well as for possessing any required permits, qualifications, registrations and insurance.
The Operator may apply identification, moderation or document and profile review procedures. If an identity verification mark is displayed next to a profile, it means only that the person has completed the identification procedure provided by the Platform. It does not confirm the Provider’s professional qualifications, experience, quality, integrity or future conduct.
Creating a standard Customer account and accessing the Platform’s main functions does not require a subscription fee. When a Confirmed Booking is created, the Operator may charge a service fee for providing the Technical Platform Services. For Standard Bookings in Switzerland, the service fee is calculated as a percentage of the Service price, is displayed before the Booking Request is submitted and does not exceed CHF 80 for one Confirmed Booking.
Where a Service involves professional advice, specific qualifications or increased risk, the Customer must independently assess whether the Service is suitable for their needs and, where appropriate, verify the Provider’s status and documents.
The Platform is not an emergency service. In an emergency, the User must contact the appropriate emergency service.
1Definitions
For the purposes of these Terms, the following definitions apply:
- “Related Person” means a child, family member or another person for whom the Customer is entitled to book a Service and provide the necessary information.
- “Booking Request” means a request submitted by the Customer through the Platform for the provision of a Service on specified terms that has not yet been confirmed by the Provider.
- “Confirmed Booking” means a Booking confirmed by the Provider or automatically confirmed in accordance with the Provider’s settings, which directly binds the Customer and the Provider to the agreed terms for providing and receiving the Service.
- “Booking” means, depending on the context, a Booking Request or a Confirmed Booking.
- “Standard Booking” means a Confirmed Booking that was not clearly identified in the interface, before submission of the Booking Request, as a premium, exclusive or extended Booking subject to special conditions and a separate service fee.
- “Instant Booking” means a Booking for a Service that is intended to begin immediately or within a short period after confirmation and is clearly identified in the interface as urgent or instant.
- “Provider” means an individual, self-employed person, sole trader, company or other service provider offering Services through the Platform.
- “Content” means texts, images, documents, reviews, messages, profiles and other materials available through the Platform.
- “Payment Provider” means an independent third-party payment service provider connected to the Platform for the authorisation, processing, allocation, payout or refund of funds.
- “Technical Platform Services” means search, Booking, scheduling, communication, connection to a payment mechanism, artificial intelligence tools and other digital functions provided by the Operator.
- “Remote Service” means a Service provided remotely, including a video consultation, online lesson or another communication-based Service.
- “Service” means a service offered and provided by a Provider to a Customer or a Related Person.
2Acceptance of the Terms
By creating an account, selecting the relevant box confirming acceptance of the Terms, submitting a Booking Request, purchasing a paid function or performing another action for which the Platform expressly requires acceptance of these Terms, you confirm that you have read and accepted these Terms and any applicable special rules clearly brought to your attention before the relevant action.
If you do not agree with these Terms in whole or in part, you must not create an account, make a Booking or use the Platform and its functions.
3Eligibility
To independently create an account, enter into a Confirmed Booking, assume a payment obligation or purchase a paid function through the Platform, you must be at least 18 years old and have the legal capacity required under applicable law.
Services for a minor may be booked by the minor’s legal representative or another duly authorised adult.
4Personal Customer Account
4.1Account Creation and Use
Certain search functions may be available without an account. A personal account is required to make Bookings, arrange payments, manage schedules and use personalised functions.
An account is created for one individual and must be used by that individual. You may not create false or duplicate accounts, transfer access to another person or impersonate another person.
You agree to provide accurate, complete and current information, not to create a false identity, not to mislead GOGO, Providers or third parties, and to update your information promptly when it changes.
4.2Booking for a Related Person
You may use your account to book Services for yourself or for a Related Person under your responsibility.
When making a Booking for a Related Person, you confirm that you are entitled to:
- provide and use the necessary personal data of that person;
- select and book a Service on that person’s behalf or in their interests;
- receive information, notifications and messages relating to the Booking;
- arrange for that person to receive the Service.
When making a Booking for a Related Person, you remain the Customer and are responsible for the Booking, the accuracy of the information provided, the selection of the Service and the performance of all Customer obligations.
If the Related Person is an adult who independently controls their personal data, you confirm that you have their consent or another lawful basis for providing their data and agree to inform them about the Booking and provide them with access to the Privacy Policy.
4.3Confidentiality of Access Credentials
Your access credentials are personal and confidential. You must keep them secure and promptly notify the Operator through the designated GOGO support channel of any suspected loss, theft or unauthorised use of your account.
To the extent permitted by law, you are responsible for actions carried out through your account before the Operator receives the relevant notification.
5Notifications and Messages
5.1Service Notifications
The Operator may send you information through GOGO by means of in-app messages, push notifications, SMS or email where this is necessary for creating and performing a Booking.
Such information may include confirmations, changes, reminders, payment and cancellation notifications, and practical information concerning the Provider.
5.2Provider Messages
A Provider may send you messages through the Platform in connection with a booked Service.
If a Provider sends a message outside GOGO’s technical communication channels, the Provider is responsible for that message.
5.3Technical Limitations
The Operator does not guarantee the immediate or error-free delivery of every notification and is not responsible for a delay or failure to receive a message caused by incorrect contact details, device settings, telecommunications operators, email services or other circumstances outside the Operator’s reasonable control.
The absence of a reminder does not by itself cancel a Confirmed Booking.
6Search and Provider Directory
6.1Search
The Platform allows Users to search for Providers and Services using various criteria, including category, location, language, price, availability, Service format and other parameters.
Search results and automatically generated suggestions are intended to facilitate selection and do not constitute professional advice or a guarantee that a Provider will meet the Customer’s individual needs.
6.2Incomplete Results
The Operator does not guarantee that the directory includes every Provider or every available Service in a selected category or geographical area.
You remain free to choose a Provider and are not required to use the search results displayed by the Platform.
6.3Profile Information
Unless expressly stated otherwise, Providers publish and update information about themselves, their Services, qualifications, prices, location and availability.
The Operator does not guarantee that such information will always be current, accurate or complete.
If a profile contains a verification mark, that mark confirms only completion of the specific procedure described on the Platform. It does not mean that the Operator recommends the Provider, controls the performance of the Service or guarantees its result.
A price indicated by a Provider must be considered together with the parameters of the specific Booking. The Service price, service fee, other mandatory amounts and total amount payable are displayed to the Customer before the Booking Request is submitted.
6.4Provider Status
The Provider must indicate whether they offer Services in the course of a professional or commercial activity or act as a private individual.
Where required by applicable law, the relevant status is displayed to the Customer before the Booking Request is submitted.
The mandatory consumer rights available to the Customer may depend on the Provider’s status.
Nothing in the Platform interface or in the Provider’s declaration changes the Provider’s legal status where, based on the actual circumstances and applicable law, the Provider must be treated as a professional or commercial service provider.
7Booking Service
7.1Making a Booking
The Customer may make a Booking for themselves or for a Related Person by selecting the Service, Provider, date, time, frequency and other available parameters.
The Customer must review all material terms before confirming the Booking Request.
Before submitting a Booking Request, the Customer is given an opportunity to review and correct the information entered and to check:
- the Service selected;
- the Provider;
- the date, time and other Booking parameters;
- the Service price;
- the Operator’s service fee;
- the total amount payable;
- the recipient of the Service;
- the applicable cancellation conditions.
An action that creates a payment obligation is clearly identified in the interface.
A Confirmed Booking is created directly between the Customer and the Provider after the Provider confirms the Booking Request or the request is automatically confirmed in accordance with the Provider’s settings.
A Confirmed Booking requires the Provider to perform the agreed Service and the Customer to comply with the agreed Booking terms, including the applicable payment and cancellation conditions.
The Operator is not a party to the Confirmed Booking and does not assume the Customer’s or Provider’s obligations relating to the provision, receipt, quality, safety or result of the Service.
The main terms of the Confirmed Booking are sent to the Customer electronically and are stored in the Customer’s account where the relevant function is available.
The Provider may propose a change to the time, price or other terms or may reject the Booking Request. A material change requires confirmation by the Customer before an obligation to pay for the modified Booking arises.
7.2Recurring Bookings
The Platform may allow Users to create one-time, advance or recurring Bookings.
For a recurring Booking, the Customer must review:
- the relevant dates;
- the time;
- the frequency;
- any exclusions;
- the payment arrangements;
- the cancellation conditions.
Unless otherwise stated on the Booking screen, each separately confirmed performance within a recurring series is treated as a separate Confirmed Booking for the purposes of performance, cancellation and calculation of the service fee.
7.3Managing Bookings
Through the Customer’s account, the Customer may view, modify or cancel available Bookings and view their Booking history.
The possibility of modifying a Booking depends on its status and the applicable cancellation rules.
7.4Cancellation or Unavailability of the Provider
The Operator is not responsible for a Provider’s cancellation, delay or unavailability.
If the Provider cancels a Confirmed Booking, the Platform applies the refund rules displayed when the Booking was made and may offer the technical possibility of selecting another Provider.
7.5Provider Obligations
The Provider acts independently and must perform the Service in accordance with the agreement with the Customer, applicable law and professional requirements.
Use of the Platform does not reduce the Provider’s responsibility towards the Customer.
7.6Customer Obligations
A Confirmed Booking creates an obligation for the Customer.
If the Customer is unable to use the Service, the Customer must cancel it in a timely manner through the Platform or by another permitted method.
The Customer is responsible towards the Provider for a no-show, late cancellation, incorrect instructions, failure to provide necessary access and other breaches of the Booking terms.
7.7Restriction of Booking Functions
The Operator may restrict or block the ability to make new Bookings in the event of repeated no-shows, non-payment, misuse of cancellation functions, fraud or another material breach of these Terms.
Such restriction does not terminate payment obligations that have already arisen.
8Payments, Service Fees, Cancellations and Refunds
8.1Free Registration
Creating a standard Customer account and accessing GOGO’s main functions does not require a subscription fee.
Free registration does not release the Customer from the obligation to pay:
- the Provider’s Service price;
- the applicable service fee;
- the price of any separately activated paid function.
8.2Service Price and Service Fee
The Service price is set by the Provider or determined on the basis of parameters directly agreed between the Customer and the Provider.
The Operator does not set the Service price and does not determine the Provider’s remuneration.
Before the Booking Request is submitted, the Customer is shown:
- the Service price;
- the Operator’s service fee;
- other mandatory amounts;
- the total amount payable.
The total amount includes applicable taxes, including VAT where chargeable, and all mandatory charges that do not depend on the Customer’s choice.
The service fee constitutes the Operator’s remuneration for the Technical Platform Services and is not part of the Provider’s Service price.
For Standard Bookings in Switzerland, the Customer’s service fee is calculated as a percentage of the Service price and does not exceed CHF 80 for one Confirmed Booking.
When the Platform is used outside Switzerland, the maximum amount may be displayed in another supported currency as an equivalent amount, taking into account the applicable exchange rate and the Payment Provider’s rules.
This limitation does not apply to Bookings that are clearly identified in advance as premium, exclusive or extended Bookings, provided that their price and special conditions are displayed to and expressly accepted by the Customer before the relevant Booking Request is submitted.
Any change to the limitation applicable to Standard Bookings applies only to future Bookings after the amended Terms enter into effect.
8.3Payment Provider
Payments are processed through an independent Payment Provider.
Payment details may be entered through the Payment Provider’s interface, including an interface technically integrated into GOGO.
The scope of payment information available to the Operator depends on the applicable payment configuration. The Operator may receive limited information necessary to identify a transaction, display its status, connect it to a Booking, arrange a refund, provide payment history and resolve a payment dispute.
The Operator does not hold User funds and does not provide banking, deposit-taking or escrow services.
Depending on the applicable payment configuration, the Payment Provider may:
- accept a payment in connection with a Booking;
- authorise or charge the payment method;
- reserve or temporarily retain the relevant amount;
- allocate the relevant amounts between the Provider and the Operator;
- transfer the relevant amount to the Provider;
- transfer the applicable service fee to the Operator;
- process a cancellation, refund or chargeback.
The Operator receives amounts due to it as service fees and other payments expressly agreed for the use of Platform functions.
Payment is made in the currency displayed before the operation is confirmed and supported by the Platform and the Payment Provider.
Where currency conversion is required, the applicable exchange rate and any related charges are determined by the Payment Provider or the User’s financial institution unless the Platform expressly states otherwise.
The precise procedure for payment authorisation, charging, reservation, temporary retention, allocation, payout, cancellation and refund depends on the applicable payment configuration and is communicated to the User before confirmation of the relevant operation.
8.4Additional Paid Functions
Certain additional functions available to the Customer may be provided for a fee, including additional artificial intelligence functions and use of AI services beyond a free usage limit.
Professional or commercial subscriptions, enhanced profiles, Content promotion and advertising placement by Providers or advertisers are governed by separate applicable terms.
A paid function is activated only after the User has been clearly informed of:
- the content of the function;
- the price;
- the currency;
- the duration;
- the renewal procedure;
- the cancellation procedure.
The User must expressly confirm the purchase.
The reference in these Terms to the possible introduction of a paid function does not itself create an obligation to pay until the User separately activates that function.
8.5Payment Methods
The Platform may allow Users to choose between several payment methods supported by independent payment and other third-party service providers.
The available payment methods are displayed before the Booking is confirmed and may vary depending on the country, currency, type of Service, User’s device and applicable payment configuration.
Where cash payment or another method of direct settlement between the Customer and the Provider is available in the interface, the Users are responsible for completing that settlement directly.
The advance payment, temporary retention, automatic transfer and refund mechanism operated through the Payment Provider does not apply to such a direct payment method unless expressly stated otherwise in the interface.
The Operator does not receive or hold User funds. Authorisation, reservation, charging, temporary retention, transfer and refund of funds are performed by the independent Payment Provider in accordance with the applicable payment configuration.
8.6Advance Payment and Temporary Retention of Funds
Where online payment is selected for a Booking, the Payment Provider may, before the Service begins:
- authorise the payment method;
- reserve the relevant amount;
- charge an advance payment;
- temporarily retain the amount until the conditions for its transfer are satisfied.
The specific payment procedure is displayed to the Customer before the Booking is confirmed.
Unless expressly stated otherwise before confirmation of the Booking, the amount relating to the Service price is transferred to the Provider after the scheduled completion of the Service, provided that the Customer has not reported the Provider’s no-show, non-performance or material improper performance through the designated technical functions of the Platform within the applicable period.
The applicable service fee is transferred to the Operator in accordance with the payment configuration and the rules displayed to the Customer before confirmation of the Booking.
Technical reservation or temporary retention of an amount by the Payment Provider does not mean that the Operator receives funds for safekeeping or provides banking, deposit-taking or escrow services.
8.7Confirmation of Performance and Automatic Transfer
After the scheduled completion time of the Service, the Customer may be invited to confirm completion of the Service or report a problem.
If the Customer does not report the Provider’s no-show, non-performance or material improper performance through the designated GOGO function within 24 hours after the scheduled completion of the Service, the Service is treated as completed for the purposes of technical payment processing.
After that 24-hour period expires, the Payment Provider may automatically release, transfer or allocate the relevant amounts to the Provider and the Operator in accordance with the Booking terms and the applicable payment configuration.
Expiry of the 24-hour period terminates the special temporary payment retention mechanism but does not deprive the Customer of any rights that cannot be limited under applicable law.
8.8Provider No-Show, Non-Performance or Material Breach
If the Provider does not attend, does not begin performance or does not perform the Service, the Customer must report this through the designated GOGO function no later than 24 hours after the scheduled completion time of the Service.
Where such a report is submitted within the applicable period:
- automatic transfer of the disputed amount to the Provider is suspended where technically possible;
- the Platform records the report and may request relevant information from the Customer and the Provider;
- the Payment Provider may cancel the authorisation, release the reserved amount or process a refund;
- where the Provider’s no-show or complete non-performance is confirmed, the online amount paid by the Customer, including the applicable service fee, is refunded unless otherwise required by mandatory law;
- in the event of material improper performance, a full or partial refund may be issued having regard to the nature of the breach, the part of the Service actually performed and applicable law.
Submitting a report does not constitute automatic acceptance of the Customer’s claim.
The Operator may facilitate the exchange of information and apply technical measures within the functions of the Platform but does not assume the Provider’s obligation to perform the Service.
Where the Provider disputes the Customer’s report, the Operator may request supporting information from both parties and maintain the disputed status of the transaction until a technical decision is made in accordance with the Payment Provider’s rules.
8.9Cancellation Rules Set by the Provider
The Provider may select the available cancellation rules for their Services from the options supported by the Platform.
The applicable cancellation rules must be clearly displayed to the Customer before the Booking Request is submitted and become part of the Confirmed Booking after their acceptance by the Customer.
The Provider’s cancellation rules may not limit Customer rights that cannot be excluded or restricted under applicable law.
Where the Provider has not selected separate cancellation rules, the standard GOGO rules set out in this Section apply.
8.10Advance Bookings
Unless otherwise clearly stated by the Provider and accepted by the Customer before the Booking is confirmed, the Customer may cancel an advance Booking no later than 24 hours before the agreed start time of the Service.
Where an advance Booking is cancelled within this period, the advance online payment is refunded to the Customer. The treatment of the applicable service fee is displayed before confirmation of the Booking.
Where an advance Booking is cancelled less than 24 hours before the Service is due to begin, the cancellation rules selected by the Provider and displayed to the Customer before confirmation of the Booking apply.
Subject to applicable mandatory law, those rules may provide for a full refund, partial refund or no refund.
8.11Instant Bookings
An Instant Booking is a Booking for a Service that is intended to begin immediately or within a short period after confirmation and is clearly identified in the interface as urgent or instant.
Where an Instant Booking is cancelled at the Customer’s initiative or due to circumstances attributable to the Customer after confirmation by the Provider, the amount paid is not refunded unless:
- otherwise provided by the Provider’s cancellation rules;
- the Provider voluntarily agrees to a refund;
- performance of the Service has not begun and mandatory applicable law gives the Customer a right to a refund;
- the cancellation was caused by the Provider’s actions, no-show or breach.
Where an Instant Booking is not performed due to circumstances attributable to the Provider, Section 8.8 applies.
8.12Cancellation by the Provider
If the Provider cancels a Confirmed Booking or states that they cannot provide the Service, the online payment is not transferred to the Provider and is cancelled, released or refunded through the Payment Provider.
Where the cancellation is initiated by or attributable to the Provider, the online amount paid by the Customer, including the applicable service fee, is refunded unless otherwise required by mandatory law or the relevant amount relates to a separately purchased paid Platform function that has already been fully provided.
The Platform may offer the Customer the technical possibility of selecting another Provider, but the Customer is not required to accept a replacement.
8.13Customer No-Show
If the Customer does not attend, does not provide necessary access, does not connect to a Remote Service or otherwise makes performance of the Service impossible for reasons attributable to the Customer, the event is treated as a cancellation attributable to the Customer.
A refund is available only to the extent provided by the Provider’s cancellation rules displayed before confirmation of the Booking or required by mandatory applicable law.
8.14Recurring Bookings
Unless expressly stated otherwise on the Booking screen, each separately confirmed performance within a series of recurring Bookings is treated as a separate Booking for the purposes of payment, cancellation, no-show, confirmation of performance and refund.
Cancellation of one performance does not automatically cancel the remaining performances in the series.
The procedure for cancelling the entire series must be displayed to the Customer before confirmation of the recurring Booking.
8.15Partially Performed Services
Where a Service has been partially performed, the amount to be transferred to the Provider or refunded to the Customer is determined having regard to:
- the part of the Service actually performed;
- the agreed Booking terms;
- the reason the Service was discontinued;
- the information provided by the Customer and the Provider;
- applicable law.
Where the parties independently agree on a partial payment or refund through the functions provided by the Platform, the Payment Provider may process the corresponding allocation within its technical capabilities.
8.16Refund Processing Times
The time required for a refunded amount to be credited depends on the Payment Provider, the selected payment method and the User’s financial institution.
After a refund is initiated, GOGO may display its status but does not guarantee a specific crediting time where that time depends on an independent service provider or financial institution.
8.17Payment Disputes and Chargebacks
The User may use the designated GOGO support channel to report a problem concerning a payment, Booking or refund.
Contacting GOGO does not restrict the User’s statutory rights or any rights available under the rules of the payment method used.
The User must not initiate a knowingly unfounded chargeback, obtain a refund through multiple methods for the same amount or provide false information in connection with a payment dispute.
The Operator and the Payment Provider may consider the transaction history, Booking status, communications between the parties and other information relevant to the dispute.
8.18Payment Confirmations and Invoices
Information concerning a transaction that is available to the Operator is retained in the User’s payment history where that function is available.
A payment confirmation may be provided by the Payment Provider or through GOGO’s technical interface.
The Provider is responsible for issuing an invoice, receipt or other document relating to the Service price where such an obligation applies to the Provider.
The Operator is responsible for providing a document relating to its own service fee or another paid Platform function where such a document is required by applicable law.
8.19Mandatory Consumer Rights
These payment, cancellation and refund rules apply subject to the mandatory consumer rights of the relevant country.
Where applicable law gives the Customer a right to withdraw from a distance contract within a prescribed period, that right is not restricted by these Terms.
Where the Customer requests that performance of a Service begin before the expiry of a mandatory withdrawal period, the Customer may be required to separately confirm:
- consent to the beginning of performance;
- the obligation to pay for the part of the Service actually performed;
- the loss of the right of withdrawal after full performance of the Service, where provided by applicable law.
Special rules may apply to urgent repairs, Services provided on a specific date, fully performed Services and other categories specified by applicable law.
9Remote Services and Video Communication
9.1Provision of a Remote Service
If a Provider offers a Remote Service, the Customer may use a communication tool made available through the Platform or otherwise agreed with the Provider.
The Customer must connect at the agreed time and verify that their device, microphone, camera and internet connection are functioning properly.
9.2Connection Quality
The Customer is responsible for providing a suitable device, software and internet connection.
If the Service cannot be performed because of technical conditions on the Customer’s side, the cancellation and payment rules disclosed before the Booking apply.
9.3Responsibility for the Content of a Remote Service
The Operator provides or connects the technical communication infrastructure and is not responsible for the content, advice, instructions, materials or result of a Remote Service.
The Provider independently determines whether the relevant Service can properly be provided remotely and is responsible for its performance.
9.4Confidentiality and Recording
Each participant must use video communication and other communication tools in a manner that respects confidentiality and third-party rights.
Recording, copying or distributing another person’s image, voice, messages or materials is permitted only with that person’s consent or another lawful basis.
The Operator does not record video communications unless the User is clearly informed otherwise in advance.
10Intellectual Property
Rights in the GOGO project, the Platform and related intellectual property belong to the project owner and/or other rights holders.
Trade Navigator Group SA uses, develops, operates and commercialises such rights as the exclusive licensee and Operator of the Platform.
The Operator grants you a personal, limited, non-exclusive, revocable and non-transferable right to use the Platform for its intended purpose and in accordance with these Terms.
Without prior authorisation, you must not:
- copy, modify, decompile or extract the source code of the Platform;
- resell or commercially exploit the Platform;
- introduce malicious code;
- conduct unauthorised penetration testing;
- disrupt the operation of the Platform;
- collect data through automated means;
- use the Platform to create a competing product;
- distribute spam;
- circumvent technical restrictions;
- systematically avoid applicable Operator fees.
11Modification, Suspension and Termination
11.1Modification of Platform Functions
The Operator may modify, update, temporarily suspend or discontinue individual Platform functions.
If a change materially affects a paid Platform function or an active Booking, the Operator will notify the User within a reasonable period unless immediate action is required for security, legal or abuse-prevention reasons.
11.2Suspension or Termination by the Operator
The Operator may restrict access to, suspend or delete an account:
- in the event of a breach of these Terms, applicable law or third-party rights;
- in the event of fraud, threats, discrimination or abusive conduct;
- where the account creates a risk for Users or the Platform;
- for another lawful and objectively justified reason.
Such restriction is a measure relating to access to the Platform. It does not constitute direction or control over the manner in which Services are performed and does not itself create an employment relationship between the Operator and a Provider.
When making a decision, the Operator may consider:
- the seriousness of the breach;
- whether the breach has been repeated;
- the need to prevent harm urgently;
- the rights of affected persons.
Suspension does not cancel obligations relating to Services already provided, payments, refunds or open disputes.
11.3Termination by the Customer
The Customer may delete their account using the relevant function or by contacting support.
Account deletion does not cancel:
- active Bookings;
- outstanding amounts;
- open disputes;
- retention of data required for compliance with the law, accounting, protection of legal claims or fraud prevention.
12Personal Data Protection
The Operator processes personal data in accordance with applicable law and the GOGO Privacy Policy.
The Privacy Policy describes:
- the purposes and legal bases of processing;
- the categories of data processed;
- the recipients of data;
- international data transfers;
- retention periods;
- data subject rights.
Depending on the function used, GOGO may process location data, Related Person data, messages, profile materials and limited payment-related information.
Access to location, contacts, camera, microphone, photographs, notifications and other device functions is granted voluntarily by the User through the device settings or the relevant Platform request.
Refusal to grant an optional permission does not prevent general use of the Platform but may make unavailable a specific function for which that permission is technically necessary.
Personal data is used for personalised advertising or other optional marketing purposes only where there is an appropriate lawful basis and, where required, the User’s separate consent.
Such consent may be withdrawn at any time.

13Cookies
The use of cookies and similar technologies is governed by the GOGO Cookie Policy where such technologies are used on the website or in the application.
14Customer Obligations
14.1Accurate Information
The Customer must provide accurate and current information when registering, searching, making a Booking, arranging a payment, communicating or submitting a complaint.
The Customer is responsible for the consequences of inaccurate, incomplete or outdated information concerning themselves or a Related Person.
14.2Lawful Use
The Customer is responsible for:
- the use of their account;
- the content of submitted materials;
- compliance with third-party rights.
The following are prohibited:
- unlawful requests;
- threats;
- discrimination;
- harassment;
- fraud;
- false reviews;
- breaches of confidentiality;
- use of the Platform in a manner capable of causing harm to another person.
14.3Responsibility for Claims and Losses
To the extent permitted by law, the Customer is responsible for documented losses and reasonable costs of the Operator directly caused by:
- the Customer’s intentional or negligent unlawful use of the Platform;
- the Customer’s infringement of third-party rights;
- the Customer knowingly providing Related Person data without the necessary authority.
This provision does not apply to the extent that the relevant loss was caused by the Operator’s own conduct.
14.4Personal Use
These Terms are intended for Customers booking Services for themselves or their Related Persons.
The Customer may not:
- resell access to the Platform;
- impersonate a Provider;
- use a Customer account for unauthorised advertising or mass commercial promotion.
14.5Compliance with Applicable Law
These Terms do not replace or override any statutory, professional, employment, social security, insurance or other mandatory requirements applicable to the Customer, the Provider or a particular Service.
Each User is responsible for determining and complying with the requirements applicable to their role and activities.
Depending on the nature of the relationship and the Service, Users may be subject to requirements concerning:
- employment relationships;
- minimum remuneration;
- social security;
- accident insurance;
- work and residence permits;
- professional registration;
- qualifications and licensing;
- occupational health and safety;
- protection of minors and vulnerable persons;
- mandatory insurance;
- reporting and other statutory obligations.
Nothing in these Terms determines the legal status of the relationship between the Customer and the Provider contrary to the actual circumstances or mandatory applicable law.
14.6Insurance
Each User is responsible for determining whether mandatory or reasonably necessary insurance is required in connection with ordering or providing a particular Service.
Where applicable law requires the Customer to arrange insurance in connection with engaging a person to perform work, the Customer must comply with that obligation.
Where applicable law, professional requirements or the nature of the activity requires the Provider to maintain insurance, the Provider must ensure that such insurance is in place and remains effective.
GOGO is not an insurer and does not confirm the existence of insurance coverage unless expressly stated otherwise for a specific function.
14.7Responsible and Ethical Conduct
Users must act in good faith, responsibly and with respect for other persons.
When using the Platform or interacting in connection with a Service, the following are prohibited:
- threats;
- discrimination;
- harassment;
- insulting or degrading conduct;
- fraud;
- knowingly false reports;
- unlawful use of personal data;
- breaches of confidentiality;
- actions that create an unjustified risk to another person.
Users must comply with reasonable professional and ethical standards applicable to the nature of the relevant Service.
14.8Service Fees, Subscriptions and Paid Functions
The User acknowledges that service fees, subscriptions and other clearly identified charges constitute the Operator’s remuneration for providing the Technical Platform Services.
The User is required to pay only those service fees, subscriptions and paid functions that were clearly displayed and accepted before the payment obligation arose.
The amount, currency, frequency, duration, renewal procedure and cancellation procedure for the relevant payment must be displayed before confirmation.
14.9Prohibition of Service Fee Circumvention
The User may not use information, contact details, messages or opportunities obtained through GOGO to systematically move Bookings outside the Platform for the purpose of avoiding an applicable service fee or another expressly agreed payment due to the Operator.
This restriction does not prohibit:
- the use of cash or another payment method expressly made available in the interface for the relevant Booking;
- communication necessary to perform the Service;
- actions that the User is entitled to take under mandatory law;
- relationships between persons that arose independently of the use of GOGO.
The Operator may restrict account functions in the event of confirmed systematic avoidance of applicable fees, having regard to the seriousness of the breach, the User’s rights and active Bookings.
14.10Technical Integrity of the Platform
The User must comply with the applicable rules of use and must not interfere with the operation, maintenance, updating or security of the Platform.
The following are prohibited:
- circumventing technical restrictions;
- interfering with the operation of the Platform;
- obtaining unauthorised access;
- creating artificial system loads;
- using automated means without authorisation;
- altering payment or technical data;
- using the Platform for fraudulent or unlawful purposes.
Temporary restriction of individual functions for maintenance, updates or security reasons does not constitute a breach of these Terms where the Operator acts reasonably and, where practically possible, provides appropriate notice.
14.11Mandatory Law
Users retain all rights that cannot be excluded or limited by contract.
Where a provision of these Terms conflicts with a mandatory provision of applicable law, the mandatory provision prevails and the remaining provisions continue to apply.
15Liability
15.1Responsibility of the Provider and Customer
The Provider is solely responsible for the offering, content and performance of the Service, including:
- legality;
- quality;
- safety;
- price;
- timing;
- professional requirements;
- result.
The Customer is responsible for:
- selecting the Provider;
- the information and instructions provided;
- performing the Customer’s obligations;
- assessing whether the Service is suitable for the Customer’s or Related Person’s needs.
15.2Role and Liability of the Operator
The Operator is not a party to a Confirmed Booking.
To the maximum extent permitted by law, the Operator is not responsible for:
- the acts or omissions of a Provider or Customer;
- failure to perform or improper performance of a Service;
- cancellation or delay;
- the quality of a Service;
- professional advice provided by a Provider;
- personal injury or property damage arising directly from the actions of the participants in the Service relationship.
The Operator does not guarantee:
- the accuracy of all information provided by Users;
- the availability of every Provider;
- the permanent availability of a particular Service;
- achievement of a particular result;
- the absence of errors in automated search, translation or suggestions;
- uninterrupted compatibility of the Platform with every device or third-party service.
Nothing in these Terms excludes or limits the Operator’s liability for wilful misconduct, gross negligence or any other liability that cannot be excluded or limited under applicable law.
In all other cases, the Operator’s liability for its own breach is limited to direct, foreseeable and proven loss to the extent permitted by law.
15.3Platform Availability
The Operator takes reasonable technical and organisational measures to operate the Platform but does not guarantee its uninterrupted or error-free availability.
The Operator is not responsible for temporary unavailability, delays or failures caused by:
- maintenance;
- updates;
- third-party providers;
- communication networks;
- the User’s device;
- force majeure;
- other circumstances outside the Operator’s reasonable control.
16Artificial Intelligence Search and Automated Functions
The Platform may use automated and artificial intelligence-based functions to process requests, categorise and translate information, perform searches, support Content moderation and display suggestions.
Such results may be incomplete or inaccurate and do not replace the Customer’s review of material Booking terms.
The automatic display of a Provider does not constitute endorsement or a guarantee by the Operator.
Before submitting a Booking Request, the Customer must review:
- the Service description;
- the price;
- availability;
- qualification information;
- other material parameters.
17Location and Maps
When maps, nearby searches, routes or location functions are used, results may depend on device data and independent mapping services.
The Operator does not guarantee the absolute accuracy of coordinates, routes or estimated arrival times.
If real-time location sharing is available for a specific Service, its purpose, recipients and period of use are indicated in the interface.
Such a function is an auxiliary technical tool and is not a security, rescue or emergency service.
18Reviews, Ratings and User Content
The Customer may submit a review following a Confirmed Booking where that function is available.
A review must:
- relate to the relevant Service;
- reflect the User’s personal experience;
- not contain knowingly false information;
- not contain threats, discrimination, insults or unlawful Content;
- not contain personal data that the User has no lawful basis to publish.
The Operator may review, restrict the visibility of or remove Content that violates these Terms, applicable law or third-party rights.
The Operator is not required to remove a negative review solely because the Provider disagrees with it.
A rating may be calculated automatically on the basis of reviews, Booking history and other clearly identified criteria. A rating is not a guarantee of the quality of a future Service.
The User retains the rights they hold in the Content they publish and confirms that they possess the rights and lawful grounds required for its publication.
By publishing Content on the Platform, the User grants the Operator a non-exclusive and royalty-free right to:
- store the Content;
- technically reproduce it;
- format it;
- translate it;
- display it;
- moderate it,
to the extent necessary to operate, secure and maintain the Platform.
This right applies for as long as the Content remains available and for a reasonable period during which it is retained in technical backups.
Use of User Content in external advertising or commercial promotion requires a separate lawful basis and, where necessary, the User’s consent.
19Booking Complaints
The Customer may submit a complaint relating to a Booking through the designated support channel and provide the information necessary for its consideration.
The Operator may:
- facilitate an exchange of information between the Customer and the Provider;
- take technical measures within the Platform’s functions;
- apply the relevant payment, cancellation and refund rules.
The Operator’s assistance in considering a complaint does not mean that the Operator assumes the obligations of the Customer or Provider.
It does not restrict either party’s right to apply to a competent authority or court.
The applicable deadlines and consequences of submitting a complaint are determined in accordance with Section 8 and the Payment Provider’s rules.
20Third-Party Content and Services
The Platform may contain links to or integrations with independent websites and services, including payment, mapping, communication and other technical services.
Such services are provided by the relevant third parties under their own terms.
The Operator does not control or guarantee the content or operation of independent third-party services, except for the Operator’s responsibility for its own selection and integration of such services to the extent required by law.
21No Additional Warranties
To the extent permitted by law, the Platform and its technical functions are provided as available.
The Operator does not provide warranties that are not expressly stated in these Terms and does not guarantee that:
- the Platform will satisfy every individual requirement of the User;
- the Platform will operate continuously and without errors;
- every error will be corrected immediately.
22Governing Law and Jurisdiction
These Terms and the relationship between the Operator and the Customer concerning use of the Platform are governed by Swiss law.
Subject to mandatory consumer protection and jurisdiction rules, the place of jurisdiction is Geneva, Switzerland.
This provision does not deprive the Customer of the right to bring proceedings in another competent court where that right is granted by a mandatory provision of applicable law.
23Language Versions
These Terms may be made available in English, French, German and Russian.
In the event of a discrepancy or difference in interpretation, the English version prevails unless mandatory applicable law requires otherwise.
Automatic translations of individual Platform elements are provided for convenience and may contain inaccuracies.
24Severability
If an individual provision of these Terms is invalid or unenforceable, the remaining provisions remain in effect.
The invalid provision applies to the maximum extent permitted by law or is replaced by a valid provision that most closely reflects its lawful purpose.
25Illegal Content and Infringement of Rights
If you believe that a profile, message, review, image or other Content is unlawful or infringes your rights, you may notify the Operator through the designated GOGO support channel and provide the necessary information.
The Operator will consider the notification and take reasonable measures having regard to:
- the nature of the alleged infringement;
- applicable law;
- the rights of affected persons.
26Subcontractors and Future Transfer of Platform Operations
The Operator may engage technical and other subcontractors to support the operation of the Platform.
Engaging a subcontractor does not release the Operator from its own obligations towards the Customer under these Terms and applicable law.
If the GOGO project is transferred to a separate legal structure, the Platform’s operations and the related rights and obligations may be transferred to that structure following prior notice to Users and, where required by applicable law or the nature of the transferred obligations, receipt of the necessary consent.
If such a transfer materially affects the User’s rights, the User will be given an opportunity, before the transfer date, to stop using the Platform and delete their account after completing existing obligations.
The transfer does not retrospectively change the terms of Confirmed Bookings and does not grant the new operator broader rights over personal data than are permitted by law and the Privacy Policy.
27Changes to the Terms
The Operator may amend these Terms.
The Operator will provide advance notice of changes that materially affect the User’s rights and obligations through the Platform, by email or through another appropriate channel, unless an immediate change is required by law or for security reasons.
The amended Terms apply from the specified effective date and do not retrospectively change the terms of a Confirmed Booking unless required by law or expressly accepted by the User.
If the User does not accept the amended Terms, the User must stop using the Platform and may delete their account after completing existing obligations.
